Each April, South Carolina Legal Services joins organizations across the country in recognizing Second Chance Month, a time dedicated to raising awareness about the challenges faced by individuals with criminal records and the opportunities available to help them move forward.
An estimated 70 to 100 million Americans have a criminal record. For many, this creates long-term barriers to employment, housing, education, and financial stability. Even after individuals have completed their sentences and paid their debt to society, these barriers, often referred to as collateral consequences, can continue to limit their ability to rebuild their lives and fully participate in their communities.
In South Carolina, however, there are meaningful pathways that offer individuals a true opportunity for a fresh start.
One of the most impactful options is expungement. Expungement is a legal process that allows certain arrest and conviction records to be destroyed. Under South Carolina law, a variety of charges, including some non-violent felonies, may be eligible for expungement. Once a record is expunged, individuals can legally state that they do not have a criminal record in most situations. This can open doors to better employment opportunities, safer housing, and increased financial stability.
